Brexit won’t negatively affect the English Legal System.

A report this week from the Law Society of England & Wales, declares optimistically, that any actual Brexit (should it ever take place!), will not damage the reputation of the legal status of England and Wales. As a firm opinion, Achieve Legal would reiterate, that due to its flexibility and stability, English law has always had the premier reputation worldwide as being the finest legal system for both Personal Law and for Business disputes.

In a report titled ‘England And Wales: A World Jurisdiction of Choice’, The President of the Law Society Mr. Simon Davis said he is “full of optimism that England and Wales will continue to flourish as a global legal centre of choice”, if Britain leaves the EU.

There is of course a mounting opinion in the legal profession, that Brexit will become a stone-cold dead experiment as the will to pass required Parliamentary endorsement continues to look extremely thin. The suggestions of yet another ‘Hung Parliament’ seems likely to be a reality after the General election on December 12th.

Mr. Davis added: “The benefits of choosing English law have not changed. It is flexible, allowing businesses and individuals to tailor bespoke agreements to fit their specific needs, offering commercial freedom”.

He cited the extremely high calibre of English and Welsh judges and lawyers, the advantages of our Common Law system and the widespread worldwide use of the English language.

It is not doubted that the possibility of Brexit has added ‘further complexity’ to competition in the legal services market, but as The report states, ‘there are some absolute certainties that will continue and are at the heart of England and Wales’ success as a jurisdiction’

English law is flexible, predictable and stable and can ‘arguably evolve more quickly than statute-based law’. We would agree with the accepted sentiments that English contract law is ‘largely unaffected by EU law’ , as it is based on common law which has evolved over 1,000 years.

On jthe subject of our court udges, the report stresses the ‘impartiality, experience and skill’ of the English and Welsh judiciary, which is ‘mainly recruited from the ranks of senior legal practitioners, usually with several decades of experience at the highest levels of practice’. On language, it says that over 1.75 billion people worldwide speak English.
